General Terms and Conditions (AGB)
As of: 2026-10-10
§ 1 Scope and Contractual Partner
These General Terms and Conditions (AGB) apply to all contracts for the use of the web-based software-as-a-service solution Shipnovo (hereinafter "Service" or "Shipnovo") between i-Garant Onlinetrading UG (haftungsbeschränkt), Cunostraße 15, 14199 Berlin, represented by Managing Director Igors Kirjanovs, email: [email protected] (hereinafter "Provider"), and the customer.
The offer is aimed at entrepreneurs within the meaning of § 14 BGB and at consumers within the meaning of § 13 BGB. Sections 10 to 12 apply additionally to consumers. Anyone using Shipnovo to sell goods commercially acts as an entrepreneur. There is no statutory right of withdrawal for entrepreneurs.
Deviating, conflicting or supplementary terms and conditions of the customer shall not apply unless their validity has been expressly agreed to in text form in advance.
§ 2 Subject Matter of Service, Scope and Availability
Shipnovo provides web-based software to support merchants in shipping and order processing (including order import, creation of shipping labels and packing lists, shipping rules, and tracking data feedback to connected marketplaces).
Shipnovo is purely a software provider and not a freight carrier, postal service provider or forwarding agent. The actual transport and delivery of shipments is carried out exclusively by the respective shipping service providers (e.g. DHL, Deutsche Post) connected and commissioned by the customer on the basis of separate contracts between the customer and these providers.
Where Shipnovo offers optional functions for AI-assisted drafting of messages or text suggestions, these are non-binding drafts. The customer is obligated to independently check all generated drafts for accuracy and completeness prior to use or dispatch.
The Provider provides the software within the framework of the current state of the art and strives for high and reliable availability. A fixed uninterrupted uptime guarantee is not owed. Necessary maintenance times, security updates and outages outside our control (e.g. disruptions to marketplace or carrier interfaces) may lead to temporary restrictions.
§ 3 Trial Period and Conclusion of Contract
New customers can test the Service for 14 days free of charge after registration without providing payment details. The trial period ends automatically after 14 days and does not convert automatically into a paid subscription.
A paid contract is concluded only when the customer selects a paid plan, completes the checkout process, and the payment is successfully authorized and confirmed via the payment service provider Stripe.
Before concluding the contract in checkout, consumers see the selected plan, the total price including value-added tax, the term, and the cancellation option. The contract is concluded only when the consumer activates the payment button in checkout (§ 312j BGB).
§ 4 Tariffs, Prices and Payment Terms
The prices of the chosen tariff displayed at checkout at the time of contract conclusion shall apply. Final prices include 19% VAT in Germany. Postage is charged separately. Postage costs for parcel and letter shipping are not billed via Shipnovo, but are charged separately by the respective shipping service provider via the customer's business accounts.
Billing for the software usage fee takes place monthly in advance via the payment service provider Stripe. There is no right to unilaterally increase prices during the current contract term.
§ 5 Term, Renewal and Termination
The paid contract is concluded for an indefinite period and automatically renews for a further month unless terminated at the end of the current billing period.
Termination is possible at any time at the end of the current billing month directly through the subscription settings in the customer account or by a message in text form to [email protected].
Consumers may also terminate under § 11.
Both parties retain the right to extraordinary termination for good cause.
§ 6 Termination of Contract and Data Handling
Order and buyer data remain stored while the customer account is active. After the contract has effectively ended, the customer may export their data through Settings / Data or instruct its deletion within 30 days. After this period, personal data is deleted unless statutory retention obligations or specifically required proof prevent this. We generally retain invoices and accounting records for eight years, and books and annual financial statements for ten years. Six years apply only to commercial and business letters where the law requires their retention in the individual case, not as a blanket period for buyer data. Fully anonymized aggregates may be stored permanently. Backup copies are overwritten or deleted no later than 30 days after their creation.
§ 7 Customer Obligations and Account Authorization
The customer remains the controller under data protection law for all personal data (particularly buyer and recipient data) processed through Shipnovo. They assure that they are authorized to collect, store and disclose this data within the Service.
The customer undertakes to connect only marketplace accounts (e.g. eBay) and shipping provider accounts (e.g. DHL, Deutsche Post) that they are authorized to control and use, and to protect access credentials against unauthorized third-party access.
§ 8 Liability
We are liable without limitation for damage arising from injury to life, body or health, for intentional or grossly negligent conduct and for mandatory statutory liability (particularly under the Product Liability Act).
For slightly negligent breaches of material contractual obligations (cardinal obligations), our liability is limited to foreseeable damage typical of the contract. Material contractual obligations are obligations whose fulfillment makes proper performance of the contract possible in the first place and on whose fulfillment the customer may regularly rely.
Liability for other slight negligence is excluded.
§ 9 Data Protection and Data Processing
Where Shipnovo processes personal data on behalf of the customer (e.g. recipient addresses for label creation), the parties conclude a separate Data Processing Agreement (AVV). Merely reading these terms or visiting the website does not conclude a Data Processing Agreement.
Further information about data processing by Shipnovo is available in our Privacy Policy.
§ 10 Right of Withdrawal for Consumers
Consumers who conclude the paid contract through the website have a statutory right of withdrawal. Entrepreneurs do not have this right. The notice and model withdrawal form follow the statutory model (Annexes 1 and 2 to Article 246a § 1 paragraph 2 EGBGB).
Withdrawal Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

You may use the model withdrawal form below, but this is not mandatory. You may also exercise your right of withdrawal online at https://shipnovo.app/widerruf. If you use this online function, we will send you an acknowledgment of receipt without undue delay on a durable medium (e.g. by email), with information about the content of the withdrawal declaration and the date and time of receipt.
To meet the withdrawal deadline, it is sufficient to send the notification concerning your exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we must reimburse all payments received from you without undue delay and no later than fourteen days from the day we receive notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you. We will charge no fees for this reimbursement.
If you requested that services begin during the withdrawal period, you must pay us a proportionate amount corresponding to the services already provided up to the time you inform us of your exercise of the right of withdrawal from this contract, compared with the full scope of services provided for in the contract.
The free trial does not create a payment obligation. For the paid contract, by completing checkout you expressly request that we begin providing the service immediately (§ 356 paragraph 5, § 357a paragraph 2 BGB).
